Membership Agreement, Terms & Conditions

These Membership Terms and Conditions ("Agreement") form the contract between Total Power Team Ltd ("TPT", "we", "our", "us") and the member (or the parent/legal guardian where the member is under 18 years of age).

By joining Total Power Team Ltd, you confirm that you have read, understood and agree to these Terms and Conditions.


1. Definitions

Member means the individual enrolled at Total Power Team Ltd.

Membership Holder means the adult responsible for the membership and Direct Debit.

Junior Member means any member under the age of 18.

Written Notice means communication sent by email, SMS, WhatsApp, letter or another written method accepted by Total Power Team Ltd.


2. Membership

Membership is a rolling monthly membership with no fixed minimum term unless otherwise agreed in writing.

Membership continues until cancelled in accordance with these Terms.

Membership provides access to classes appropriate to the member's age and grade, subject to timetable availability.


3. Membership Fees

Membership fees are collected monthly by GoCardless Direct Debit.

Membership fees are payable regardless of attendance.

Failure to attend classes does not suspend or cancel membership.

The Membership Holder is responsible for ensuring sufficient funds are available on the collection date.


4. Annual Pricing

Membership fees are calculated over a twelve-month period and divided into equal monthly payments for convenience.

Monthly payments are not payments for the number of classes attended during that month.

The annual pricing model allows Total Power Team Ltd to:

  • employ qualified instructors;

  • secure training venues;

  • maintain insurance;

  • purchase equipment;

  • invest in the continued development of the club; and

  • provide a consistent training programme throughout the year.

Monthly fees remain payable during:

  • holidays;

  • school holidays;

  • illness;

  • work commitments;

  • family commitments; and

  • any other absence,

unless membership has been paused or cancelled in accordance with these Terms.


5. Cancellation

Members may cancel at any time.

Cancellation must be made by Written Notice.

Accepted methods are:

  • Email

  • SMS

  • WhatsApp

  • Letter

  • Official online contact form

  • Any other written communication accepted by Total Power Team Ltd

Alternatively, members may cancel the Direct Debit instruction directly through their bank.

To avoid delays or misunderstandings, Total Power Team Ltd strongly recommends that members both:

  • notify Total Power Team Ltd in writing; and

  • cancel their Direct Debit with their bank.

Verbal cancellations or cancellations made in person will not be accepted.

For Junior Members, cancellation requests will only be accepted from the Membership Holder, parent or legal guardian.


6. Membership Pause

Members may request to pause their membership.

Pause requests must be submitted by Written Notice.

Verbal or in-person requests will not be accepted.

A minimum of one month's written notice is required.

Memberships may only be paused once in any rolling twelve-month period, unless otherwise agreed in writing.

GoCardless collections are submitted several working days before collection.

If a payment has already entered the banking process when notice is received, Total Power Team Ltd may be unable to stop that payment.

Where this occurs, the payment will still be collected and the pause will begin from the next available billing period.


7. Refund Policy

Membership fees remain payable until a valid cancellation request has been received or the Direct Debit has been cancelled.

Refunds will not normally be provided where payments have continued because the member did not follow the published cancellation procedure.

Failure to attend classes does not create an entitlement to a refund.

Refunds may be considered where:

  • Total Power Team Ltd has made an administrative error;

  • a payment has been taken incorrectly; or

  • required by law.

Nothing in this Agreement affects your statutory rights.


8. Failed Direct Debits

If a Direct Debit fails, Total Power Team Ltd reserves the right to request payment by an alternative method.

Persistent failed payments may result in suspension of training until the account is brought up to date.

Any outstanding membership fees remain payable.


9. Member Responsibilities

Members are responsible for:

  • following these Terms;

  • submitting cancellation and pause requests correctly;

  • ensuring requests are received;

  • checking bank statements regularly;

  • keeping contact details up to date; and

  • notifying Total Power Team Ltd promptly if they believe an error has occurred.


10. Junior Members

Where a member is under 18 years of age, all membership matters including:

  • cancellations;

  • pauses;

  • payment queries;

  • refunds; and

  • contractual decisions,

must be made by the Membership Holder, parent or legal guardian.


11. Communication

Official communications may be sent by:

  • Email

  • SMS

  • WhatsApp

  • Telephone

  • Social media announcements

  • Website announcements

Members are responsible for ensuring their contact details remain accurate.

Notices sent to the last contact details provided will be deemed delivered.


12. Timetable, Instructors and Venues

Total Power Team Ltd reserves the right to change:

  • class times;

  • instructors;

  • venues;

  • lesson content; or

  • timetables,

where reasonably necessary.

These changes do not automatically entitle members to a refund or cancellation.

Where reasonably possible, advance notice will be given.


13. Club Closures & Force Majeure

Total Power Team Ltd reserves the right to cancel, postpone, relocate or suspend classes where reasonably necessary.

This includes:

  • severe weather;

  • venue closures;

  • instructor illness;

  • emergencies;

  • public health guidance;

  • government restrictions;

  • health and safety concerns; and

  • circumstances beyond our reasonable control.

Where possible, members will be notified in advance.

We will make reasonable efforts to provide alternative classes or arrangements where practical.

Temporary closures do not automatically entitle members to refunds or compensation.

If all classes are suspended for an extended period, Total Power Team Ltd may, at its discretion, provide an appropriate remedy, such as online training, membership credits or membership pauses.


14. Health & Safety

Members must disclose any medical condition or injury that may affect safe participation.

Members train at their own risk.

All instructions given by instructors must be followed.


15. Photography & Video

Photography and video recording may take place during classes, gradings, competitions and club events for coaching, safeguarding, promotional and marketing purposes.

Where required by law, Total Power Team Ltd will obtain appropriate consent before using identifiable images of members, particularly children, for promotional purposes.

Members who do not wish to appear in promotional images should notify Total Power Team Ltd in writing. While we will make reasonable efforts to accommodate such requests, we cannot guarantee that members will never appear incidentally in the background of group photographs or videos.


16. Code of Conduct

Members must behave respectfully.

We reserve the right to suspend or terminate membership where behaviour includes:

  • abuse;

  • threatening behaviour;

  • bullying;

  • discrimination;

  • repeated disruption;

  • unsafe conduct;

  • criminal activity affecting the club; or

  • behaviour bringing the club into disrepute.


17. Suspension & Termination

Total Power Team Ltd may suspend or terminate membership where these Terms are breached.

Any refund will be considered on the circumstances and applicable law.


18. Limitation of Liability

Nothing in these Terms excludes liability where it cannot legally be excluded.

Otherwise, Total Power Team Ltd shall not be liable for indirect or consequential loss.


19. Belt Gradings & Licences

Membership fees do not include grading fees, licences, uniforms, equipment or event entry fees unless expressly stated.


20. Non-Transferable Membership

Memberships are personal to the member and cannot be transferred to another individual without written agreement from Total Power Team Ltd.


21. Entire Agreement

These Terms constitute the entire agreement between the parties and supersede any previous verbal discussions or understandings relating to membership.

No verbal statement by any instructor, volunteer or representative shall vary these Terms unless confirmed in writing by Total Power Team Ltd.


22. Severability

If any part of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.


23. Waiver

If Total Power Team Ltd chooses not to enforce a provision on one occasion, this does not waive the right to enforce it in the future.


24. Privacy

Personal information will be processed in accordance with applicable UK data protection legislation and our Privacy Policy.


25. Complaints

Complaints should be submitted in writing.

Total Power Team Ltd will investigate complaints fairly and aim to respond within a reasonable timeframe.


26. Governing Law

These Terms are governed by the laws of England and Wales.

Nothing in these Terms limits any statutory rights available under the Consumer Rights Act 2015 or other applicable legislation.


27. Acceptance of Terms

By joining Total Power Team Ltd and authorising a GoCardless Direct Debit, the Membership Holder confirms that they:

  • have read and understood these Terms and Conditions;

  • agree to be bound by them;

  • accept the cancellation and pause procedures;

  • understand the annual pricing model; and

  • acknowledge that these Terms form the contractual agreement between themselves and Total Power Team Ltd.
